TERMS OF USE

These Terms of Use, hereinafter referred to as "Terms and Conditions" or "T&C" or "Terms" or "Agreement," along with any other Policy or Statement or Information that may be placed on this website, hereinafter referred to as "Company" or “Website” or “We” or “Us,” as modified or amended from time to time, are a binding contract between the company and you, hereinafter referred to as "You" or "User" or "Your" or "Buyer" or "Customer."

If you visit, use, or shop at the site or any future site operated by us, you accept these Terms and Conditions. In addition, when you use any current or future services of the company or visit or purchase from any business affiliated with the company or third-party vendors, whether or not included in the site, you also will be subject to the guidelines and conditions applicable to such service or merchant. If these conditions are inconsistent with such guidelines and conditions, such guidelines and conditions will control.

By subscribing to or using any of our products or services, you agree that you have read, understood, and are bound by the Terms and Conditions, regardless of how you subscribe to or use our products or services. If you do not want to be bound by the terms, you must not subscribe to or use our services.

These Terms and Conditions of Supply apply to any and all products and services supplied by or on behalf

of Aus Hospitality Supplies to the Customer, save that where the Customer and Aus Hospitality Supplies

have entered into a separate agreement for the supply of products and services the terms of that

agreement will apply.


1. Price and Payment

1.1 Customer agrees to pay the prices stated for the product and services.

1.2 Unless Aus Hospitality Supplies otherwise agrees in writing, if Customer does not pay any amount invoiced within 30 days, then in addition and without prejudice to any rights or remedies available to Aus Hospitality Supplies:

(a.) Interest will be payable by Customer on the amount due at the rate of 12% per annum accuring daily from the due date until Aus Hospitality Supplies receives payment in full.

(b.) All fees incurred by Aus Hospitality Supplies in recovering the debt will be reimbursable by the customer.

(c.) All amounts invoiced to or owing by Customer will become immediately due and payable.

(d.) To the maximum extent permitted by law, Aus Hospitality Supplies accepts no liability whatsoever in connection with its performance or non-performance of this Agreement.

1.3 Invoices will be processed and accrue over a 30 day cycle between the beginning and end of any given month. At the end of each month a statement will be issued and payable in full, 30 days after that, a statement is provided.


1.4 SERVICE WORK

(a) All service work is performed on a CASH ON DELIVERY basis unless authorised by Aus Hospitality Supplies.

(b) Initial call out fee and first hour are to be paid by credit card at time of booking. 

(c) When booking a service call with Aus Hospitality Supplies you are providing authority for Aus Hospitality Supplies to charge the provided credit card on completion of the service job the final amount owing.

1.5 All parts which are supplied by Aus Hospitality Supplies remain the property of Aus Hospitality Supplies until paid for.

1.6 If parts supplied are not paid for Aus Hospitality Supplies has the right to remove supplied parts.


1.7 Warranty

(a) It is the buyers responsibility to complete all paperwork regarding warranty and send to the manufacturer within 7 days of receiving goods. If not completed warranty period period may be reduced.

(b) Warranty work is only performed Monday to Friday in normal business hours.

(c) Warranty work is only carried out by the manufacturer.


2. Refund Policy

2.1 Aus Hospitality Supplies will be entitled to withold delivery of any products and services, cancel any orders for products and services or discontinue supplying products and services to Customer until such

time as any amounts owed by Customer to Aus Hospitality Supplies are paid.

2.2 Customers will have a period of 14 days after delivery to inspect the products. If all or some of the products do not conform with any specifications provided to Customer, Customer may return such products to Aus Hospitality Supplies within 7 days after their delivery, or as otherwise agreed in writing by Aus Hospitality Supplies if the product is not within specification. Any products not so returned will be deemed to be accepted by Customer.

2.3 Products sold that are as described on the website can not be returned. unless agreed by Aus Hospitality Supplies. If Aus Hospitality Supplies agrees to return a 20% handling fee will be charged plus applicable freight charges.

2.4 Cancellation of online orders that have not been despatched will be subject to a 3% charge to cover payment processing fees plus $16 flat rate charge to cover processing the return. If Items have been despatched, we do not accept returns unless the item is not as described. See 2.7

2.5 Cancellation of catering equipment once ordered and paid for may occur a 20% handling fee and applicable freight charges.

2.6 Cancellation of catering equipment after ordered and paid for which has been stripped of packaging, will be deemed to be second hand equipment and can not be returned.


2.7 RETURNS ARE NOT CURRENTLY ACCEPTED FOR CHANGE OF MIND

No returns are accepted unless the item shipped is faulty or not as described. Please check carefully to ensure the item ordered is what you require. If you need help, contact us on 04 3333 5555 before placing your order, or as stated in 2.3.

3. Risk and Title

3.1 The risk of loss and damage to products passes to Customer on delivery to Customer or to Customer's agent or site.

3.2 Title to products supplied will not pass to Customer until Aus Hospitality Supplies has received payment in full of the price for all products supplied by Aus Hospitality Supplies to Customer.

3.3 Within 7 days of Aus Hospitality Supplies request, Customer must return to Aus Hospitality Supplies all unused products covered by the request for which Aus Hospitality Supplies has not received payment in full.

3.4 Until products are fully paid for, Aus Hospitality Supplies : (1) retain title of all products, (2) has by itself or by it's agent the unrestricted right to enter Customers premises, or the premises of any related body corporate or agent where products are located, without liability for trespass or any resulting damage, and to re-take possession of products , and (3) is entitled to keep or re-sell any products so re-possessed.


 4. Delivery

As a customer you will enjoy fast delivery to most parts of Australia.

Free delivery is available to many areas, however a minimum order and some conditions may apply.

Alternatively, email us the product/s you wish to purchase and your address, and we will contact you with the delivery arrangements for your area, sales@aussupplies.com.au


4.1 FREE SHIPPING

Free shipping is available in Australia metro areas for pre gst purchases over $200.

The regional areas plus the following states and Territories are excluded from free shipping WA, TAS, NT.

Oversize items are exempt from free shipping.

Oversize items delivered to areas other than Sydney Metro require a separate freight quotation.


4.2 Delivery Times:

Min despatch timing is next day

Max despatch timing is 14 days, unless a longer date has been pre-arranged and agreed to.

If by 7 days you still have not received your delivery please contact us on 04 3333 5555.

Same day deliveries may be available on request if urgent.

Out of stock items ordered will be refunded in full if the due date is over 14 days. You will be contacted before refund is processed to check if you are happy to wait longer than the 14 day limit.
